1854 Sale of Killiechassie

The right of sepulture is granted to Robert Stewart Flemyng and the descendants of Rev Robert Stewart and is written into the Instrument of Sasine. Harry George Gordon accepts the obligation to maintain the burial ground and chapel in a complete state of repair and this is also written into the Instrument of Sasine; the right of sepulture and the obligation to maintain are to be carried forward to all future conveyances of the Property.

At Edinburgh the twenty fourth day of February in the year one thousand eight hundred and fifty four between the hours of three and four afternoon the Instrument of Sasine underwritten was by G Greig writer in Edinburgh presented for registration and is engrossed in the two thousand six hundred and seventy first book of the new general register of sasines reversions as following viz. At Edinburgh there was on behalf of Harry George Gordon Esquire of the Oriental Bank Corporation in London presented to me Notary Public subscribing a Disposition granted by Robert Stewart-Flemyng Esquire formerly of Killiechassie, Wine Merchant in London and bearing date as in the precept of sasine and testing clause after inserted by which Disposition the said Robert Stewart Flemyng sold alienated and disposed to the said Harry George Gordon and his heirs and assignees whomsoever heritably and irredeemably all and haill the eight pound land of the Barony of Killiechassie viz the one pound six shilling land of Balnacraig the one pound six shilling eight penny land of Balnachappell the two merk land of the Mains of Ballinloan the half merk land of Croft of Mains the one pound forty penny land of Tomachellie the twenty four shilling land of Borlick and the one pound ten shilling land of Cuill lying within the Parish of Logierait late Regality of Atholl and Shire of Perth by all and haill the meiths and marches of the same as they lie in length and breadth with houses biggings yards mosses muirs meadows marshes pasturings sheillings woods as well of oak as other woods fishings as well of salmon as other fishings doves dovecots cunnies cunningaries hereyelds common pasturages with free ish and entry brewseats outsets and insets annexis connexis parts pendicles and other pertinents of the same whatsomever teinds parsonage and vicarage of the said lands But reserving always to the said Robert Stewart Flemyng and to the descendants of the late Reverend Robert Stewart of Killiechassie the undoubted right of sepulture in all time coming within the family Burying Ground or chapel situated within the foresaid lands and now enclosed by a stone wall and surrounded by trees with free and uninterrupted access thereto at all times for the purposes of sepulture or for visiting the same which chapel and wall surrounding the same with the gates and accesses leading thereto the said Harry George Gordon by acceptance of the said Disposition bound and obliged himself his heirs and successors whomsoever to maintain and uphold in all time coming in a thorough and complete state of repair Which reservation and obligation above written it was declared by the said Disposition should be inserted verbatim in the Instrument of Sasine to follow thereon and in all the future conveyances and transmissions of the said Property together with the said Robert Stewart Flemyng’s whole right title and interest in and to the said lands and others with entry at the term of Martinmas eighteen hundred and fifty three declaring however that the said Harry George Gordon should have right to the rents of said lands for grass crop eighteen hundred and fifty three and corn crop eighteen hundred and fifty four and for all succeeding. Which Disposition contains an obligation to infeft a se vel de se and a precept of sasine in the following terms “Moreover I desire any Notary Public to whom these presents may be presented to give to the said Harry George Gordon or his foresaids sasine of the lands and others above disponed. In witness whereof these presents written on this and the preceding page of stamped paper by John Kerr Clerk to James Spottiswoode Writer in Perth are subscribed by me at London on the eighteenth day of February eighteen hundred and fifty four before these witnesses Alfred Dickson Book-keeper and Charles Simpson Clerk both to Messrs Smith and Company of number twenty Queen Street Cheapside London (signed) R S Flemyng Alfred Dickson witness Charles Simpson witness” In virtue of which Precept I hereby give sasine to the said Harry George Gordon of the lands and others above described. In witness whereof I have subscribed these presents written on this and the preceding page of stamped vellum by George Greig Clerk to Messrs Lindsay Mackay and Howe Writers to the Signet Edinburgh before these witnesses the said George Greig and John Robertson also Clerk to the said Messrs Lindsay Mackay and Howe declaring that the words “the meiths” on the eighteenth line and the word “of” on the twenty second line both from the top of page first hereof are deleted before signing / signed / Dixi Alex.
